1 Appellant, James Harvey Deason, hereinafter referred to as defendant, was charged with the offense of Murder in the Second Degree, pursuant to 21 O.S.Supp. 1973 ? 701 [21-701], and was tried and convicted in the District Court, Tulsa County, Case No. CRF-76-136. The trial court sentenced the defendant to serve a term of not less than ten (10) years, nor more than life in an institution to be designated by the Department of Corrections. From said judgment and sentence, the defendant has perfected his appeal to this Court.
